Medal positions triathlon confirmed

London – GBR, August 11, 2012: The ad hoc Division of the Court of Arbitration for Sport (CAS) has denied the appeal filed by the Swedish NOC and the Swedish Triathlon Federation (STF) against the decision of the International Triathlon Union (ITU) issued on 8 August 2012. The applicants sought to have Lisa Norden ranked in the first place of the women’s triathlon event, ex-aequo with Nicola Spirig (Switzerland).

The Swedish NOC and the STF considered that the ITU did not comply with its rules because it would not have taken into account the position of the athletes’ torso to establish the ranking. For that reason, the Swedish NOC and STF requested that both athletes be ranked ex-aequo at the first place and that a second gold medal for this event be awarded to Lisa Norden.

A CAS Panel composed of Mr Stuart McInnes (UK), President, Mr Alan Sullivan (Australia) and Mr Sharad Rao (Kenya) held a hearing yesterday evening from 6pm to 9:30pm. The Swedish NOC, the STF, the ITU and Swiss Olympic were represented. The Panel rendered its decision this morning: it denied the application in view of the fact that there was no violation of any ITU rule and that the matter concerned a “field-of-play decision” which, according to long standing CAS jurisprudence, is unable to be reviewed by CAS panels except in the event that there has been arbitrariness or bad faith in arriving at such decision. —- CAS/Image © insidethegames.biz
